Privacy Policy

This privacy policy sets out how The NATIONAL BUSINESS COLLEGE uses and protects any information you provide us with.

NATIONAL BUSINESS COLLEGE is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified, then you can be assured that it will only be used in accordance with this privacy statement.

NATIONAL BUSINESS COLLEGE may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy was revised on 6th August 2020.

Personal Information

We will collect personal information about you when you enrol as a learner or apply for an apprenticeship with us:

  • Name and title
  • Gender
  • Date of birth
  • Contact information including email address
  • Employment Status
  • National Insurance Number
  • Household status
  • Prior Learning
  • Ethnic background

We will collect the above information, you may select the Prefer not to say option if you do not wish to provide. This data will be shared with the Education & Skills Funding Agency. If you are applying for a role with an Employer the data held on your CV will be shared with the Employer.

Funding

NBC will use your personal data to process or to support any application made for funding associated with your learning. For these purposes we will share the information you supply with the ESFA who may in turn share it with the European Social Fund, or other government agencies that may provide funding for your course. We may also share it with Ofsted. At the point this information is collected you will be asked to indicate if you do not wish to be contacted by the Education Skills Funding Agency or its partners in respect of courses, surveys and research. You can change your choices at any time by talking to your Trainer. Please read the ESFA Privacy Notice https://www.gov.uk/government/publications/esfa-privacy-notice. A copy of this will be stored in your Skills Portfolio.

Learner File

When you start your apprenticeship we will create a Learner File which includes the Individual Learning Plan (ILP) to hold the documents which relate to your learning and evidence of proof of identity and funding eligibility. All the agreements that you sign at the start of your apprenticeship will also be stored in this file. As you progress through your learning other documents such as initial assessment outcomes and reviews will be held on this file. The file is held electronically and can only be accessed by authorised personnel using a password.

Third Parties

To ensure you can start and complete your apprenticeship and be certificated for your achievement we need to share your information with third parties, including:

Awarding Organisations: Your information will be shared with awarding organisations if you are completing functional skills or other certificated courses. We will enter your information onto an online e-portfolio and assessment system (Skills Portfolio) which holds your information and everything connected to your apprenticeship and its delivery. Access to this system is secure and only you, NBC and the awarding organisation have access to the information.

Assessment Organisations: including Skills Builder for initial assessments and the relevant end point assessment organisation. Any external companies we use are responsible for protecting the data they hold on individuals.

Quality Assurance Organisations and ESFA reporting: We use a system called Maytas to inform the ESFA who we have on programme. This system is secure and can only be accessed by authorised personnel.

Survey Software Providers: You will periodically be sent feedback surveys. This will be via an online platform that is accessible only by NBC. You do not have to complete any survey but any data you choose to share will be accessed and utilised by us but held by the software provider who are responsible for protecting the data they hold on individuals.

Protecting your personal information

We are registered as a data controller and processor in line with the GDPR and UK Data Protection Act, 1998. As a registered data controller, we are required to take appropriate technical measures to protect your personal information including making a regular backup of our system and data. We have security measures in place to make sure any personal information we collect is secure. Any systems we provide you access to or utilise for the purposes of reporting to ESFA are owned and maintained by third party organisations who have separate privacy, security and data protection policies which ensure your safety. We are not responsible for the privacy policies of other companies. These systems are password protected. If you think someone else knows your password, or is using it, tell us immediately and change your password. All parties with access to your information are subject to confidentiality obligations. Even though we take appropriate technical steps to protect your security, you should remember that data transmission over the internet cannot always be guaranteed as 100% secure so you use website applications at your own risk.

Keeping your personal data

We keep personal data and Learner Files:

  • To fulfil the purposes we collected it for, The ESFA and Awarding Bodies stipulate the length of time we need to retain information for. After this time it will be confidentially destroyed.
  • As required by law
  • To enforce or defend legal claims.

Sometimes we will keep information you have sent your Trainer as evidence of your learning with NBC.

Your Rights

You have the right to:

  • Ask for a copy of all the information we hold about you (an admin fee may be charged) and to correct any inaccuracies. To obtain a copy of this information please email Keely Carleton.
  • Challenge the accuracy of data held about you.
  • Take steps to prevent your personal data being processed if the processing is likely to cause you unjustified distress.
